What is overbooking

An overbooked flight is when an airline sells more tickets on the plane than there are seats. Therefore, passengers may be bumped from the aircraft even though they were on time.

Your rights

Aviation passengers are protected thanks to European Union law according to Regulation 261/2004. The airline should pay you immediately once you’ve been denied boarding for your flight. Additionally, they have to offer you re-routing or a refund for your flight.

Eligibility to be compensated

  • The flight took off in the EU (from any airline) or landed in the EU (provided that the airline is headquartered in the EU).
  • You did not volunteer to surrender your seat in exchange for vouchers or other benefits.
  • You were not denied boarding for a reason under your control (for example, you showed up too late at the departure gate, or did not have the correct documentation).
  • You encountered these problems on a flight operated no more than three years ago.
  • You have not accepted any financial compensation from the airline (financial or travel vouchers).

Amount of compensation

You could be eligible to be compensated up to €600, but it depends on the distance and whether your flight is within the EU or not.
All flights 1.500 km or less
Internal EU flights over 1.500 km
Non-internal EU flights between 1.500 km and 3.500 km
Non-internal EU flights over 3.500 km

  • Boarding in the advanced state of pregnancy
  • Decision of government
  • Inappropriate behaviour
  • Late close-in
  • Security risks
  • Health problem
